1. Acceptance of Terms

By accessing and using the services provided by Tejweb Private Limited ("Company", "we", "us", or "our"), you ("Customer", "you", or "your") acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

If you do not agree with any part of these terms, you must not use our services. We reserve the right to modify these terms at any time, and such modifications will be effective immediately upon posting on our website.

2. Services Description

Tejweb Private Limited provides the following services:

• Dedicated Server Hosting
• Managed IT Services
• Linux & Windows Server Management
• Network & Security Management
• Backup & Disaster Recovery
• Annual Maintenance Contracts (AMC)
• Hardware Procurement & Lifecycle Management
• Software License Procurement & Management

The specific terms of each service will be detailed in the respective Service Agreement or Order Form signed between you and the Company.

3. Account Terms

3.1 Account Registration

To use our services, you must provide accurate and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

You are solely responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other security breach.

3.3 Age Requirement

You must be at least 18 years of age to use our services. By using our services, you represent and warrant that you meet this age requirement.

4. Payment Terms

4.1 Pricing

All prices are quoted in Indian Rupees (INR) and are exclusive of applicable taxes unless otherwise stated. Taxes will be applied as per prevailing government regulations.

4.2 Payment Schedule

Payment terms are as follows:

• Monthly services are billed in advance
• Annual contracts require payment as per the agreed schedule
• Setup fees, if any, are due upon service activation

4.3 Late Payments

Late payments may result in service suspension. A grace period of 7 days is provided after the due date. Services may be suspended without further notice after this period.

4.4 Refund Policy

Refunds are processed on a case-by-case basis. Setup fees and domain registration charges are non-refundable. For dedicated servers, a pro-rata refund may be available within the first 7 days of service activation.

5. Acceptable Use Policy

You agree not to use our services for any unlawful purpose or in any way that could damage, disable, or impair our services. Prohibited activities include but are not limited to:

• Hosting illegal content or engaging in illegal activities
• Distributing malware, viruses, or harmful code
• Sending spam or unsolicited communications
• Attempting unauthorized access to systems or networks
• Infringing on intellectual property rights
• Hosting adult content without prior approval
• Running cryptocurrency mining operations without authorization
• Engaging in activities that cause network abuse or excessive resource usage

Violation of this policy may result in immediate service termination without refund.

6. Service Level Agreement (SLA)

6.1 Uptime Guarantee

We guarantee 99.9% network uptime for our dedicated server hosting services. This excludes scheduled maintenance, which will be notified in advance.

6.2 Support Response Time

Technical support response times vary based on the priority of the issue:

• Critical: 30 minutes (server down, major service outage)
• High: 2 hours (significant performance degradation)
• Medium: 8 hours (minor issues affecting operations)
• Low: 24 hours (general inquiries, feature requests)

6.3 SLA Credits

If we fail to meet the guaranteed uptime, you may be eligible for service credits as per the terms outlined in your specific Service Agreement.

7. Termination

7.1 Termination by Customer

You may terminate your services by providing written notice as per the terms of your Service Agreement. Early termination of annual contracts may be subject to early termination fees.

7.2 Termination by Company

We reserve the right to terminate or suspend your services immediately if:

• You violate these Terms and Conditions
• You fail to make payments as agreed
• You engage in activities that harm our network or other customers
• Required by law or regulatory authorities

7.3 Effect of Termination

Upon termination, your access to services will be revoked. Data will be retained for 7 days post-termination, after which it will be permanently deleted.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• Our total liability shall not exceed the amount paid by you for services in the twelve (12) months preceding the claim
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• We shall not be liable for loss of data, revenue, profits, or business opportunities
• We are not responsible for any third-party services or content hosted on our infrastructure

9. Indemnification

You agree to indemnify, defend, and hold harmless Tejweb Private Limited, its directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses arising out of:

• Your use of our services
• Your violation of these Terms
• Your violation of any third-party rights
• Content hosted or transmitted through your account

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Panipat, Haryana, India.

Before initiating any legal proceedings, parties agree to attempt resolution through good-faith negotiations for a period of 30 days.
